If you’re accused of a crime and your liberty is somehow threatened (for example, with potential jail time), you’re entitled under the United States constitution to be represented by an attorney.
It’s important to have a criminal defense lawyer to represent you as soon as possible in the process, ideally at arraignment. A criminal defense attorney can:
- Challenge probable cause for arrest
- Negotiate plea bargains with prosecutors
- Discuss the pros and cons of going to trial
- Discuss the advantages and disadvantages
of pleading guilty instead of going to trial
Getting A Public Defender Appointed
If you can’t afford to hire a lawyer from the private legal community, the court can appoint a government-paid lawyer called a “public defender“- to represent you.
In order to have a public defender, you’ll have to convince the judge that you can’t afford to hire an attorney on your own. The judge may ask you to fill out a form detailing your financial resources, assets, income and debts. You may also need to provide the court with documentation such as paystubs to prove your income level.
Standards for how much money you can make and still qualify for a public defender vary greatly from state to state, and sometimes from one court to another.
In rural areas and in courts with meager resources, there might not be public defenders on staff with the court to represent you. In that case, the court will usually appoint a private attorney at public expense, or assign a private attorney from a volunteer attorney list to represent you.
In some courts, judges allow for what’s called “partial indigency” representation: you have the help of a public defender, but are expected to reimburse the court some of the cost of representation after the trial.
If you give inaccurate information to the court in an effort to get a public defender appointed, you may be charged with the crime of falsifying information.
If the court decides you make too much money to qualify for a public defender, you’ll want to immediately start looking for a private attorney to defend you.
Disadvantages Of A Public Defender
One downside of being represented by a public defender is that these government-paid lawyers often have a huge overload of cases, and cannot devote a lot of time to any one case. As a result, you may have little or no access to your lawyer except during actual court hearings.
Public defenders also often lack office equipment and adequate research access, and can’t afford to hire investigators to properly flesh out your case.
Public defenders are often young and inexperienced, and are “cutting their teeth” on high-volume misdemeanor cases such as DWIs.
A public defender also won’t be able to assist you with related civil law or administrative matters (such as driver’s license revocation hearings in a DWI case). You’ll need to hire a separate attorney to help you with these concerns.
Advantages of A Public Defender
Public defenders work with the same judges and prosecutors day in and day out, and get to know their personal quirks, peeves and tolerances. They also see the same police officers testifying, and know who’s likely to be a bad (and good) witness.
Public defenders usually work in “niched” areas of legal specialty, such as DWI or domestic violence defense. So they tend to be up-to-date on new law and legal theories in their area of specialty.
A public defender is likely to be very efficient at sizing up your case and presenting an acceptable plea bargain deal to the prosecutor and judge. As a result, you may be done with the criminal process and on with the rest of your life sooner than if you were represented by a private attorney.
Second Guessing Your Public Defender
Once you’ve been appointed a public defender, it’s often very difficult, if not impossible, to have your attorney replaced with another public defender.
If you’re having doubts about advice your public defender gives you, make an appointment for a “second opinion” consultation with a private criminal defense attorney. Most lawyers are willing to consult for a small fee, and you’ll have the peace of mind of knowing your public defender is on track.

I am a legal resident of United States since November 9th 1959. On 1987 I pleas guilty in three charges of false statments, I was a federal witness again others co-defendants. I got 7 years in prison I did 34 months and 5 years probation, I finished my sentence on December 1999, judge Hupp recommended no deportation how I asked in the plea agreement.during this time I never had any letter or comunication with INS.
My problem is I HAVE TO CHANGE MY STATUS IN USA and I don’t have the money for an immigration attorney I hope somebody can help me, I am 62 years old and don’t have any family in my original country

at present i am working as appraiser in a private company since 2001. the company decided to pulled me out at other branch that was 2003 w/o proper training w/o any comments knowing that they’re my boss during my term theres a lot of customer came to my branch especially those who owned a diamond jewelries. on my own knowledge of appraisng i am confidently appraising them as ol i know is correct. after a year over we’re on auction process they’ve find out those appraisal are incorrect and over-appraised w/c is i just follow the guidelines they give to us and the one i learn in appraising those diamonds. till the time they charge on my accountabilities a worth of 250,000 plus. all my monthly allowances and incentives supposed to be are captured by them. My son was accused of selling crack to an undercover but he is innocent. He has a court appointed attorney. They offered him five years probation but he wants to take it to trial. They said that if he is convicted, he will probably have to serve one year. He does not have a record. Should he take the probation or go to trial? Hi, My name is Aris, I was bank teller for WF for 2 years and I am trying to find out if I have a case against it , I was terminated about a month ago cause of force balacing , an incident that was not my fault and have no intention of doing it on purpose, It was a mistake between myself and another employee that could have been merited as a warning. I was investigated one day after a week it happened and on the same day got discharged. They were insisting that I have intentions of getting some money and the questions are misleading, I have a good employee record and I wouldnt lose a job for a $500 balancing mistake. I rely heavy on my health benefits cause of my heart condition, And also it is not in our employee guidelines and handbook that force balancing would terminate you right away but we were warned it could. office of clermont county during my case of ovi. my plea bargain was to
plead guilty to the ovi and the other charges would be dropped. i have a
warrant for my arrest on one of the charges that was involved in that plea
bargain. i have tryied to get this matter solved for the past week now.
mentally i cant think, sleep, eat, function in life because my world is off
balance now. I am mentally insane, bi polar, physio by the state of Ohio.
and everything points right now to destroy everything i have worked for in
the past 4 years.

My boyfriend is in jail right now for a violation of an injunction. His daughters mother put an injunction against him because she was mad that he didn’t want to be with her. While having the injunction she called the police and said that he called her, so they arrested him for contact, which he never did call her. He did 46 days in jail before being released on probation, now he violated for not making it to probation one day, even though he called. Will the 46 days that he did before count towards his jail time now?

Can a bank over draw you account by $4400.00 when I do not have check guarantee that is offered by the bank. I had about $600 in my account with a balace of Approx. $600.00?When my SS check was automatically deposited they took all of the $1102. leaving me with $00.00 to live on. It is my understanding that the
Banks cannot charge the exbordant charges when an account has insufficient funds due to the monies coming from SS income. I believe it was B of A that was sued for this same problem and they lost. I know many seniors that are having the same problem.
